His case is the first of this kind, even though he is far from the first Iranian diplomat to be identified as playing a role in the Iranian regime\u2019s well-known terrorist activity.<br \/>\nThe Assadi case is a hopeful sign that Western governments may finally be taking a more serious approach to holding Iranian officials accountable for their malign behavior on the world stage. This is a litmus test for the EU.<br \/>\nAfter the Belgian court makes its ruling, that hope will be further amplified by the opening of another case in Sweden. And that latter case will have implications not just for potential Western victims of Iranian state terrorism, but also for the domestic victims of Tehran\u2019s political violence.<br \/>\nThe defendant in the Swedish case is a former deputy prosecutor, interrogator, and member of the Islamic Revolutionary Guard Corps (<a target=\"_blank\" href=\"https:\/\/www.ncr-iran.org\/en\/ncri-statements\/irgc-s-38-year-record-war-crackdown-exporting-terrorism-fundamentalist-and-advancing-the-nuclear-weapons-drive\/\" rel=\"noopener\">IRGC<\/a>) named <a target=\"_blank\" href=\"https:\/\/www.ncr-iran.org\/en\/news\/report-of-the-judicial-committee-of-the-national-council-of-resistance-of-iran-no-2\/\" rel=\"noopener\">Hamid Noury<\/a>, and he is reputed to have played a role in the worst known crime against humanity to take place in Iran, the 1988 massacre of 30,000 political prisoners.<br \/>\nBy the summer of 1988, he had been working for several years under Assadollah Lajevardi, the notorious warden of Evin Prison, and had demonstrated a penchant for securing confessions from detainees via torture. His position and his reputation made him a prime candidate to work alongside the \u201c<a target=\"_blank\" href=\"https:\/\/iran1988.org\/perpetrators\/\" rel=\"noopener\">death commission<\/a>\u201d that was convened that summer in response to a <a target=\"_blank\" href=\"https:\/\/www.ncr-iran.org\/en\/iran-1988-massacre-of-political-prisoners\/iran-1988-massacre\/\" rel=\"noopener\">fatwa<\/a> from the regime\u2019s Supreme Leader Khomeini, in which he stated that all political prisoners who remain loyal to the People\u2019s Mojahedin of Iran (<a target=\"_blank\" href=\"https:\/\/english.mojahedin.org\/i\/primer-the-history-the-peoples-mojahedin-organization-iran\" rel=\"noopener\">PMOI\/MEK<\/a>) must be executed.<br \/>\nSoon thereafter, death commissions were set up all over the country and mass executions started.<br \/>\nIn the span of just a few months, those commissions collectively oversaw an estimated <a target=\"_blank\" href=\"https:\/\/www.ncr-iran.org\/en\/iran-1988-massacre-of-political-prisoners\/key-events-of-1988-massacre-of-political-prisoners-in-iran\/\" rel=\"noopener\">30,000 hangings<\/a>. NGOs seek justice at Human Rights Council for this crime against humanity. US House of Representatives bill H.Res.188 seeks justice for the victims of the massacre. UN Special Rapporteur on Iran criticizes regime for repressing families of victims. It&#039;s time to hold the perpetrators of the 1988 massacre accountable. High Commissioner Zeid Al Hussein must launch a commission of inquiry into this crime against humanity. Justice for the Victims of the 1988 Massacre in Iran\"><\/div><\/div><div class=\"lL\" style=\"max-width:100%;width:853px;margin:5px;\"><\/div><\/p>\n<p>Though Hamid Noury did not formally sit on the commission, eye-witnesses placed him in interrogation rooms and personally participating in the execution of the prisoners in Gohardasht prison.<br \/>\nLast month, seven UN human rights experts <a target=\"_blank\" href=\"https:\/\/www.ncr-iran.org\/en\/news\/human-rights\/significance-of-un-experts-letter-on-1988-massacre-victory-for-justice-seeking-movement\/\" rel=\"noopener\">published<\/a> an open letter to Iranian authorities in which they criticized the international community for its failure to deal with this crime, which in their opinion could qualify as crimes against humanity.<br \/>\n\u201cIn December 1988,\u201d the experts wrote, \u201cthe UN General Assembly passed [a] resolution\u2026 which expressed \u2018grave concern\u2019 about \u2018a renewed wave of executions in the period July-September 1988\u2019 targeting prisoners \u2018because of their political convictions.\u2019 However the situation was not referred to the Security Council, the UN General Assembly did not follow up on the resolution and the UN Commission on Human Rights did not take any action.\u201d<br \/>\nThe letter ultimately includes a rare indictment of laissez-faire Western attitudes which have exacerbated the awful human rights situation in Iran for more than three decades. Since its December publication, it has been embraced by human rights advocates as one sign of a shift toward assertiveness in Iran policy.<\/p>\n<p><a target=\"_blank\" href=\"https:\/\/stats.sender.net\/forms\/dGYVLa\/view\" rel=\"noopener\"><img decoding=\"async\" title=\"Weekly-Signe-up-logo-300x100\" class=\"size-medium wp-image-219239 aligncenter\" src=\"https:\/\/www.ncr-iran.org\/en\/wp-content\/uploads\/2020\/05\/Weekly-Signe-up-logo-300x100.png\" alt=\"Weekly-Signe-up-logo-300x100\" width=\"300\" height=\"100\" \/><\/a><br \/>\nThe Swedish case against Hamid Noury is another example. It is moving forward based on the principle of universal jurisdiction that allows the Swedish judiciary to file charges against a person who has committed crimes against international law outside Sweden.<br \/>\nNow we must hope that this realization is broadly shared among Western nations, and not just those that are in a position to prosecute Iranian terrorist and tortures on their own soil, but also those that wield influence at the United Nations and can push the international body to launch a thorough investigation into the 1988 massacre. Hamid Noury\u2019s eventual conviction will be a step in the right direction and a sign that at least Sweden is unwilling to let rampant human rights abuses to go unpunished. But it is not enough.
