Dr. Rajavi was assassinated in 1990 near his Geneva home by a 13-member <a target=\"_blank\" href=\"https:\/\/www.ncr-iran.org\/en\/ncri-statements\/terrorism-fundamentalism\/kazem-rajavi-iran-ncri\/\" rel=\"noopener\">hit squad<\/a> acting upon orders from the regime\u2019s top authorities. Dr. Rajavi was a representative to Switzerland for the National Council of Resistance of Iran. The perpetrators were promptly identified, but not before fleeing back to Iran. No willing authority has ever been able to execute the arrest warrants for the operatives or their handler.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify\"><span data-contrast=\"auto\">After the public prosecutor for the Swiss canton of Vaud announced the imminent closure of the case, the Iranian opposition\u2019s attorneys argued in court that the killing of Dr. Rajavi was not merely an act of murder but was part of a much larger crime that could be prosecuted at the international court as an instance of genocide. His assassination came two years after the <a target=\"_blank\" href=\"https:\/\/www.ncr-iran.org\/en\/news\/the-1988-massacre-in-iran\/\" rel=\"noopener\">massacre<\/a> of political prisoners during the summer of 1988.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify\"><span data-contrast=\"auto\">The assassination of\u00a0Dr.\u00a0Rajavi was carried out in accordance with the same fatwa which underlay the 1988 massacre \u2013 one in which then-Supreme Leader Ruhollah Khomeini declared that all members and supporters of the\u00a0Mujahedin-e Khalq (MEK)\u00a0were guilty of \u201cenmity against God\u201d and should therefore be\u00a0executed without delay. The fatwa named the\u00a0MEK, or who opposed the regime\u2019s fundamentalist interpretation of Islam. Therefore,\u00a0Dr.\u00a0Rajavi\u2019s killing can also be linked to a series of other assassinations that took place during the same era, all of which represent the regime\u2019s effort to wipe out\u00a0the organized Iranian Resistance Movement.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<div class=\"lyte-wrapper\" title=\"Assassination of Kazem Rajavi to be investigated in context of &ldquo;genocide,&rdquo; That case was initiated by Swedish authorities following\u00a0Noury\u2019s\u00a02019 arrest, which was justified by reference to universal jurisdiction. This action was taken pursuant to Section 7031(c) of the Department of State, Foreign Operations, and Related Programs Appropriations Act, FY 2020, making ineligible for entry into the United States officials of foreign governments and their immediate family members about whom the Secretary of State has credible information of involvement in a gross violation of human rights. This action includes visa restrictions on 13 officials involved in a brutal and intricately planned assassination carried out in Switzerland in 1990 as part of Iran\u2019s ongoing worldwide campaign of violence and terrorism. These 13 individuals, who posed as Iranian diplomats, were acting under the highest orders of their government to silence opposition and show that no one is safe from the Iranian regime, no matter where they live,\u201d read the State Department\u2019s statement. It announced the names of these terrorists as follows: Ali Reza Bayani Hamadani, Said Danesh, Ali Hadavi, Saeed Hemati, Mohammad Reza Jazayeri, Mohsen Sharif Esfahani, Ali Moslehiaraghi, Naser Pourmirzai, Mohsen Pourshafiee, Mohammad Said Rezvani, Mahmoud Sajadian, and Yadollah Samadi. On August 21, Mrs. Maryam Rajavi, the NCRI\u2019s President-elect, welcomed the U.S. decision in designating the assassins of Prof. Rajavi and described it as an \u201cessential and effective step to combat terrorism and to safeguard the security of European countries.\u201d \u201cThe designation should be complemented by blacklisting of those who ordered this crime: Ali Khamenei; the incumbent ministers of Intelligence and Foreign Affairs, Ali Fallahian and Ali Akbar Velayati; and Hassan Rouhani, the incumbent secretary of the Supreme Security Council. Prosecution, punishment, and blacklisting of the murderers of Prof. Rajavi and the clerical regime\u2019s leaders has been postponed for years by European countries, emboldening the regime to resort to further bloodshed and terrorism in Europe.\u201d Mrs. Rajavi added. Background: The Iranian Resistance, as the only viable alternative to the mullahs\u2019 regime, has been the target of the regime\u2019s terrorist plots. Dr. Rajavi\u2019s assassination case is one the strongest cases of the regime\u2019s terrorism abroad, because the operatives, their commanders and those who made this decision in Tehran were identified. In addition, the motive behind this assassination is clear, the date of entry and departure of the terrorists was clear. In 2006, an investigating magistrate in Switzerland issued an arrest warrant for Ali Falahian, then the regime\u2019s Minister of Intelligence and Security (MOIS), for \u201ccarefully planning\u201d the assassination of Dr. Rajavi. In addition, it was revealed that 13 terrorists, who had diplomatic passports, were able to go back to Iran, without being tried for their crime. This designation, years after the Iranian Resistance\u2019s endeavors to mobilize the international community to stand against the regime\u2019s terrorism abroad and human rights violations in Iran, is the first step to hold all the regime\u2019s officials to account for their ongoing human rights violations. In this regard, Dr. Rajavi\u2019s assassination case, as someone who was seeking justice for the victims of the 1988 massacre of over 30,000 political prisoners in Iran, mostly members of the MEK, is indeed considered as part of the case of the regime\u2019s crime against humanity in 1988. The closure of the Swiss case against Dr. Rajavi\u2019s killers would have surely been a prime example. But the Swiss court\u2019s September 23 <a target=\"_blank\" href=\"https:\/\/www.ncr-iran.org\/en\/news\/human-rights\/iran-the-swiss-court-rules-that-dr-kazem-rajavis-assassination-should-be-investigated-in-context-of-genocide\/\" rel=\"noopener\">decision<\/a> was a step in the right direction.
