On September 9, 2026, the International Atomic Energy Agency\u2019s 35-member Board of Governors voted 23 to three, with eight abstentions, to report Iran to the Security Council for breaching its nonproliferation obligations. It is the first such referral since 2006.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h2 style=\"text-align: justify;\" aria-level=\"2\"><span data-contrast=\"none\">How It Got There<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:160,&quot;335559739&quot;:80}\">\u00a0<\/span><\/h2>\n<p style=\"text-align: justify;\"><span data-contrast=\"auto\">The immediate cause predates the current military confrontation surrounding Iran. On June 12, 2025, the IAEA Board formally found Tehran in noncompliance with its safeguards agreement. The Agency had spent years investigating undeclared nuclear material and activities. It concluded that Iran had repeatedly failed to provide full and technically credible explanations and that the Agency could not verify that nuclear material required to be safeguarded had not been diverted.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span data-contrast=\"auto\">The findings were serious. The IAEA assessed that several <a href=\"https:\/\/www.armscontrol.org\/factsheets\/iaea-investigations-irans-nuclear-activities\" target=\"_blank\" rel=\"noopener\">undeclared locations<\/a> had formed part of an earlier structured nuclear program involving undeclared nuclear material. Iran had also become the only non-nuclear-weapon state producing and accumulating uranium enriched to 60 percent\u2014a level far beyond ordinary civilian requirements and close to weapons-grade material in technical terms. Yet even after formally establishing noncompliance, the Board postponed the final referral.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The NCRI <a href=\"https:\/\/x.com\/Iran_Policy?ref_src=twsrc%5Etfw\">@Iran_Policy<\/a> made 133 revelations about <a href=\"https:\/\/x.com\/hashtag\/Iran?src=hash&amp;ref_src=twsrc%5Etfw\">#Iran<\/a>&#39;s regime nuclear weapons program, including Natanz &amp; Arak in 2002 &amp; Fordow in 2005. <br \/>Were it not for NCRI, the mullahs would have had the bomb by now.<br \/> <a href=\"https:\/\/t.co\/XfZko3ql2T\">https:\/\/t.co\/XfZko3ql2T<\/a><a href=\"https:\/\/x.com\/FoxNews?ref_src=twsrc%5Etfw\">@FoxNews<\/a> <a href=\"https:\/\/x.com\/CNN?ref_src=twsrc%5Etfw\">@CNN<\/a> <a href=\"https:\/\/x.com\/AFP?ref_src=twsrc%5Etfw\">@AFP<\/a> <a href=\"https:\/\/x.com\/AP?ref_src=twsrc%5Etfw\">@AP<\/a> <a href=\"https:\/\/x.com\/Reuters?ref_src=twsrc%5Etfw\">@Reuters<\/a> <a href=\"https:\/\/x.com\/hashtag\/NCRIAlternative?src=hash&amp;ref_src=twsrc%5Etfw\">#NCRIAlternative<\/a><\/p>\n<p>&mdash; Ali Safavi (@amsafavi) <a href=\"https:\/\/x.com\/amsafavi\/status\/1936617760756261046?ref_src=twsrc%5Etfw\">June 22, 2025<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p style=\"text-align: justify;\"><span data-contrast=\"auto\">Calling the ensuing 15 months another opportunity for diplomacy obscures what happened. The regime had already been given years to answer the IAEA\u2019s questions. The Agency recorded repeated meetings, proposals and high-level consultations but \u201cno significant progress.\u201d Continuing to postpone consequences after formally determining noncompliance was not productive diplomacy; it was appeasement\u2014more time granted without verified compliance. On September 9, the <a href=\"https:\/\/www.usnews.com\/news\/world\/articles\/2026-09-09\/iaea-board-passes-resolution-reporting-iran-to-un-security-council\" target=\"_blank\" rel=\"noopener\">Board finally completed<\/a> the process required under the IAEA Statute and sent the matter to New York.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h2 style=\"text-align: justify;\" aria-level=\"2\"><span data-contrast=\"none\">The Lesson of 2006<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:160,&quot;335559739&quot;:80}\">\u00a0<\/span><\/h2>\n<p style=\"text-align: justify;\"><span data-contrast=\"auto\">There is a powerful precedent. On February 4, 2006, the IAEA Board reported Iran\u2019s nuclear case to the Security Council after years of concealed activities and unresolved questions. The Council adopted Resolution 1696 that July, demanding suspension of enrichment. When Tehran refused, Resolution 1737 followed on December 23, imposing binding sanctions under Chapter VII. Further resolutions subsequently widened the restrictions.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span data-contrast=\"auto\">The obstacle today is obvious. Tehran\u2019s allies among the Security Council\u2019s permanent members can veto a new binding resolution, and two of them opposed the IAEA referral itself. That may prevent the Council from reproducing the sequence that followed the 2006 referral.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Told <a href=\"https:\/\/x.com\/IngrahamAngle?ref_src=twsrc%5Etfw\">@IngrahamAngle<\/a> on <a href=\"https:\/\/x.com\/FoxNews?ref_src=twsrc%5Etfw\">@FoxNews<\/a> that the nuclear weapons program, which has cost <a href=\"https:\/\/x.com\/hashtag\/Iran?src=hash&amp;ref_src=twsrc%5Etfw\">#Iran<\/a> 2 trillion $, was the guarantee for the regime&#39;s survival. Referral and Security Council action are two different things. The September decision does not itself impose new sanctions. What it does is establish, through the international body legally responsible for nuclear safeguards, that Iran is in continuing noncompliance and place that finding formally before the institution responsible for international peace and security.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h2 style=\"text-align: justify;\" aria-level=\"2\"><span data-contrast=\"none\">Why It Matters<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:160,&quot;335559739&quot;:80}\">\u00a0<\/span><\/h2>\n<p style=\"text-align: justify;\"><span data-contrast=\"auto\">That shift has consequences even if a veto prevents the next step. The dispute can no longer be portrayed simply as a quarrel over the expired political bargains of the <a href=\"https:\/\/armscontrolcenter.org\/the-iran-deal-then-and-now\/\" target=\"_blank\" rel=\"noopener\">2015 nuclear agreement<\/a>. At its center are Iran\u2019s underlying NPT safeguards obligations: undeclared nuclear material, unanswered questions and an IAEA unable to provide assurance that everything requiring safeguards has remained in peaceful activities.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span data-contrast=\"auto\">The referral also creates an authoritative basis for governments to intensify diplomatic isolation, financial pressure and national or coordinated sanctions without waiting for unanimity in the Security Council. More fundamentally, it restores the nuclear issue to the international-security framework from which years of accommodation had progressively removed it.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\"><a href=\"https:\/\/x.com\/hashtag\/OnThisDay?src=hash&amp;ref_src=twsrc%5Etfw\">#OnThisDay<\/a>: The NCRI&#39;s August 14, 2002 revelation triggered the IAEA inspections of Iranian nuclear sites for the first time and led to six UN Security Council Resolutions. This NCRI&#39;s patriotic act hindered the regime in getting the nuclear bomb and contributed to world peace. <a href=\"https:\/\/t.co\/FE6HokSlvx\">pic.twitter.com\/FE6HokSlvx<\/a><\/p>\n<p>&mdash; NCRI-U.S. Rep Office (@NCRIUS) <a href=\"https:\/\/x.com\/NCRIUS\/status\/2088261230670549116?ref_src=twsrc%5Etfw\">August 14, 2026<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p style=\"text-align: justify;\"><span data-contrast=\"auto\">Mrs. Maryam Rajavi, President-elect of the National Council of Resistance of Iran, <a href=\"https:\/\/www.maryam-rajavi.com\/en\/welcoming-referral-un-security-council-nuclear-dossier-iran\/\" target=\"_blank\" rel=\"noopener\">welcomed the decision<\/a> on September 9, while arguing that referral alone was insufficient. \u201cPlacing this regime under Chapter VII of the UN Charter is a necessary step for international peace &amp; security,\u201d she said. She also called for Tehran\u2019s record of executions and repression to be brought before the Security Council.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span data-contrast=\"auto\">That distinction is crucial. The September 9 vote is not the end of the nuclear confrontation, nor does it guarantee a binding UN resolution. Its importance is that after years in which violations were documented while consequences were repeatedly deferred, the international system has finally restored the central fact of the case: Iran\u2019s unresolved nuclear conduct is no longer merely a negotiating problem in Vienna.
