NCRI – In a binding resolution, the Danish Parliament’s European Affairs Committee called for the full implementation of the European Court of First Instance’s ruling, which annulled the terror label against the People’s Mojahedin Organization of Iran (PMOI). The Committee criticized the Danish government for failing to consult it before the January 30th Council of Ministers’ decision.<\/p>\n
Referring to the past cases of decisions which led to the inclusion of entities within the EU terrorist list, the Resolution stressed, “On 12 December 2006, the Court of the First Instance of the Court of Justice by means of a court ruling annulled in the decision to register MKO\/OMPI on the terror list. According to the ruling, which in the majority’s opinion must be followed word for word, no sufficient reasons had been presented, and the MKO\/OMPI had not had a chance to be heard.”<\/p>\n
The Resolution stipulated that an independent authority must be established for the purpose of gaining insight into the work done by the EU’s Clearing House, where the member states’ intelligence services make the final decisions on the terror list. The Resolution specifically stated, “Naturally, the intelligence services must play a central role, and the work must necessarily be carried out confidentially. However, an independent authority must be established for the purpose of gaining insight into the work done by the Clearing House. The independent authority should also process complaints by those who feel their registration on the list is unfair, allowing for the possibility of deletion from the list.”<\/p>\n
Referring to the Council of the European Union’s Legal Service interpretation that the December 12th, 2006 Court ruling contested the material contents of the terror decision, nor the actual legal basis (the Council of the European Union’s resolution 2006\/379\/EC) for keeping the PMOI(MEK) on the EU Terrorist List, the Resolution noted that the majority of the European Affairs Committee believe that the European Court ruling with regards to the PMOI must be fully implemented. The Resolution also expressed dissatisfaction with the lack of involvement of the committee after the ruling of 12 December 2006, while noting that the majority is satisfied with the minister’s apology in this regard.<\/p>\n
